These terms apply to your use of errv-rescue.com and the ERRV Rescue Calculators web application (the “Service”), operated by ERRV Rescue. By registering or using the Service you agree to these terms and our Privacy policy.
1. The Service
We provide online planning calculators for emergency response and rescue vessel operations (including Rescue Time, OTSW, and multi-asset scenarios). Features depend on your subscription tier (Free, Vessel, or Fleet).
2. Beta and professional disclaimer
Calculators may be labelled Beta or awaiting verification. Results are planning aids only, not operational instructions, regulatory approvals, or substitutes for qualified judgement. You are responsible for verifying all outputs before use in real operations. We do not guarantee accuracy, completeness, or fitness for a particular purpose.
3. Accounts
- You must provide a valid email and keep your password secure.
- You must be at least 16 years old and authorised to bind your organisation if you register on its behalf.
- One person per account unless we agree otherwise in writing.
- You must not share credentials or misuse the Service.
4. Subscriptions and payment
- Free tier offers limited read-only access as described on the site.
- Vessel and Fleet are paid monthly subscriptions billed through Stripe.
- Prices are shown on the site (currently £100/month Vessel, £225/month Fleet; we may change prices for new subscribers with notice).
- Upgrades (e.g. Vessel to Fleet) may be charged on a prorated basis via Stripe without a separate checkout page.
- You may cancel via My account or Stripe Customer Portal; access typically continues until the end of the paid period unless stated otherwise.
- Refunds follow Stripe and our reasonable discretion except where UK consumer law requires otherwise.
5. Acceptable use
You must not: reverse engineer the Service; attempt unauthorised access; upload malware; scrape at scale; resell access; or use the Service unlawfully. We may suspend or terminate accounts that breach these terms.
6. Intellectual property
We own (or license) the Service, software, branding, and documentation. You receive a limited, non-exclusive licence to use the Service for your internal business purposes while your subscription is active. You retain ownership of data you enter; you grant us a licence to host and process it to provide the Service.
7. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, consequential, or loss-of-profits damages, or for reliance on calculator outputs. Our total liability for any claim arising from the Service is limited to the fees you paid us in the twelve months before the claim (or £100 if none). Nothing limits liability for death or personal injury caused by negligence, fraud, or other liability that cannot be excluded under UK law.
8. Availability
We aim for reliable hosting but do not guarantee uninterrupted access. Maintenance or outages may occur.
9. Changes
We may update these terms. The “Last updated” date will change. Continued use after changes constitutes acceptance. Material changes to paid terms will be communicated reasonably in advance where practicable.
10. Governing law
These terms are governed by the laws of England and Wales, and where you live or your business is established in Scotland, by the laws of Scotland to the extent they apply.
If you are resident in Scotland, you may bring court proceedings in Scotland. If you are resident in England or Wales, proceedings may be brought in the courts of England and Wales. If you are a consumer elsewhere in the UK or EEA, you keep any mandatory rights to bring claims in your country of residence where the law allows.
